Abandonment

My husband left me the day after we got our refinance check in the mail of which he took half of and 3 weeks worth of paychecks, left me with a mortgage and a van payment, he was the sole source of income. He had 2 affairs durring the marriage got one girl pregnant and is living with another, I have not heard from him in 4 weeks, my question is does michigan have abandonment laws and if so what are my rights?

Just see a good divorce lawyer. If you are in Wayne, Oakland or Macomb County, give me a call at 248-353-9400. You can get a nice child support order, take the money out of his paycheck, and get him to pay most of the house note as well as utilities, etc. The fact that you let it get this far indicates that you are reluctant to take action. You should take action immediately. As far as adoption is concerned, since they are his kids, make him pay support. Bill Stern

I was very sorry to here about your situation. If you had children as a result of the marriage statute dictates a 6 month waiting period before the divorce decree can be enterred. If there were no children a divorce can be had in as little as 60 days. Despite your current financial dilemma an attorney can assist you with division of the marital debts and assets that would be incorporated into a Settlement agreement, as well as helping you to compute spousal support payments. If the decision is to obtained a divorce the sooner the better for you so you can get on with your life.
