adopting my niece

I have had legal permanent custody since my niece was 14 mo., she is now 10 yrs. I want to adopt her but my sister will not give permission. My sister has been in and out of prison and has never tried to regain custody until she found out that her daughter is eligible for disability payments. My niece does not want to go with her as I am the only mother she knows. My sister has visited with her twice in all these years. Can she come and fight for her? what are my chances of winning this and being allowed to adopt her?

Your complex question cannot be properly answered on the internet. The mother's right might be able to be terminated but doing that is a complex legal proceeding.

You should promptly meet with an aggressive and experienced family law attorney in your area.

Why don't you file a petition in the county probate court for guardianship. This may solve your problem and allow you to get the social security. William S. Stern
