Allimony for a stay at home mom?

As a stay at home mom for 7 years, am I entitled to any allimony? My husband and I had agreed that I should remain home with the children, ages 6 and 2, until they were school age. I had given up a full time position with a company which has since has gone out of business. I do have a BA and would be able to obtain some position eventually.

Hello: I have received a copy of your question regarding alimony or spousal support. There are a number of factors that must be considered in determining if alimony is appropriate. You have mentioned 3 of them, ie.: length of marriage, your role in the marriage, and your educational background. Others include the marketability of your education, the length of time you need to find a job, the efforts necessary to make you "employable". and your husband's income.

Most likely you would be able to obtain spousal support (alimony) for a limited period of time. Choose a family law attorney and have him run your various factors through the prognosticator program and you will get your likely answer.

You will probably be entitled to spousal support and child support (if primary physical custody of the children is with you). Michigan law has developed to pay spousal support for a limited duration, generally for enough time to allow the non-working party a chance to get back into the working environment - be it through increased education, or time to find a job. There are numerous factors that are involved in determining the amount that will be set as to spousal and child support (too many to list here).
