My niece will be 18 in Nov. She starts 12th grade in Sept. and wants to know if she has to be amancipated from her mom or can she just move out..Her mom and dad do not live together. They live about 3 hrs. apart and she wants to finish school where she is so her boyfriends family will let her live with them so she can do that..

If she is under 18 and wants to move out, and her parents won't give her permission, then she would need to become emancipated to live on her own and not be treated as a runaway. However, depending on the county, it can take a few months for the court to decide an emancipation petition, and therefore, it might be fruitless to file it at this date when her 18th birthday is only a few months away. She should just wait until she turns 18 and then move out, given the short timeframe, unless there are emergency situations that warrant her moving out now or sooner than November.
