Legal Question in Family Law in Michigan

Amend Bad Divorce Order

I have come to realize that my attorney did nothing to help me make the right decisons in my divorce and now it's hitting me. I have been divorced since 09/2001 and thought it was all over. Well...I'm still stressing over it because of the bad advice given to me by my ''lawyer''. I wan to know if it is possible to amend a divorce order already ruled on by the courts?

Re: Amend Bad Divorce Order

I am afraid that the general rule for amendments to orders is that it may only be done in cases of (1) mutual mistake or (2) fraud. Bad advice, not reading or understanding the provisions of the settlement agreement are typically not grounds for amendments.

Now, if there was fraud or mutual mistake you may have grounds for a revision of the agreement, though this tricky area of law will almost certainly require the use of another attorney.

Best of luck,
