amendment to tax refund after divorce

I was divorced in 2001. My ex-husband and I had previously satisfied a debt with the department of education by having our tax refunds taken and then filing and injured spouse claim form. The debt was originally mine. I found out today that he had filed an injured spouse claim form against our jointly filed 2000 tax return, in the year 2003, and has subsequently recieved in Augugst of this year the entire amount minus interest that we paid in over the years to satisfy this debt. My question is, is it legal for him to file this form after the divorce was final in 2001, and also should this have been done without my knowledge and consent?
