Legal Question in Family Law in Michigan
Annulment
My husband of 9 weeks passed away unexpectedly about a month ago. Since his death I have found out about many things he did not tell me about. If I would have known these things before I would have never married him! Now $15k (funeral and burial costs plus other misc. things) later, I want to get my marriage to him annuled. I was made a fool and I have too much respect for myself to have this on my permanent record. I've been told mixed answers from NO you can't do that because he is dead to YES you can get it done if you open an Estate and have a family member appointed as administrator and they can speak on my husbands behalf. I need as many replies as possible because before I go and spend a lot of money to get this done I want to make sure it can be done. My husband has nothing, absolutely nothing, at this point, I wouldn't want anything from him anyways. All I want is an annulment and my dignity back. Please help!!!!

Re: Annulment
There are very few reasons which would qualify you for an annulment, such as "fraud", i.e., your husband was really a woman or he was sterile and did not tell you, etc. Since I don't know exactly what you "discovered" after his death, I cannot give you a legal opinion as to whether you may qualify for an annulment.
Assuming there was no fraud, and simply some habits he hid from you, it's a waste of time to pursue this.
While someone appointed to administer his estate could handle legal matters on your husband's behalf, they CANNOT testify as if they were your husband, and therefore, there is no point in opening an estate to have someone "speak" to facts that need to come from your husband's mouth.
I would use it as a learning example and simply move on.
