Appealing a divorce decision
I was recently granted a divorce, however, was not happy with the split of marital assets, and the judges decision regarding who pays for health insurance costs. Many facts were not brought out due to the fact that my attorney was young and inexperienced, and I was ill-advised. Can I now go back with a new attorney and appeal the judges decision?

You may be able to modify the judgment, with the right attorney assisting you.

It may be possible to amend the judgment of divorce. If not, you could file an appeal with the Court of Appeals (providing there are legitimate reasons to do so). If you are simply unhappy with the outcome that may not be a legal reason for an appeal. Normally, property is divided 50/50 unless fault can be attributable to one of the parties in such a case most courts would divide the property 60/40 in favor of the party who is not at fault. As to the health insurance issue, if it is for the children take it up with the Friend of the Court. The cost of an appeal may be prohibitive. It will cost you thousands for the appeal. Most appeals are not granted. Speak with an attorney you trust to see if your divorce attorney failed to do his or her job and to provide you with guidance on how to proceed if indeed an appeal is indicated. Good luck.
