Assets in a divorce

If we own a home that is now worth $35000 to $50000 less than we owe on it will i have to bye her out to keep the house?

There are lots of other factors that go into a property agreement or decision by a judge. If you have a lawyer, it sounds like the question is going to be who gets saddled with the debt. There may be lots of other factors, such as charge plates, other loans, other assets, inheritances, spousal support, where kids will lives, etc. If you don't have a lawyer, get one. William S. Stern

You can't buy out equity in a home if no equity exists. There are usually other factors to consider and your questions should be directed to an experienced family law attorney.
