Attorney Error

Property settlement was done verbally on courtroom steps. When stated in front of the judge, the terms contradict each other. I agreed to a sum of money, cash in my pocket, tax free. My attorney stated in court the non-taxable amount and in questioning the defendant, said cash. The opposing attorney added by way of QDRO. The only way to receive cash from QDRO is for someone to pay the tax. Who should bare the burden of the tax and if that is me, can I hold my attorney financially liable for misrepresentation?

There is no way to answer this without more information, but if this judgment was entered recently, you should try contacting your attorney about vacating the judgment first. You would want to have an attorney review the facts of what happened (including the transcript) in order to determine whether you'd have a case against your attorney.
