Attorney Failure
My attorney has erred twice now on QDRO benefit from ex-husband. First, attorney did not submit papers to company responsible for calculating my monthly income. Once done, I was sans 3 months of income due to the attorney's error; second, attorney did not submit proper information on %monthly amount due me. Amount awarded is too much to me and needs to be reduced. No problem, but attorney is not taking responsibility and expects me to pay for the service AGAIN. Says, since I signed off 4 yrs ago, she should be ''retained'' again. I paid for this service to be done correctly by the attorney, but it was not. Should I have to pay them again? Should I look into suing the attorney? Issue is going to court once more. Attorney wants her firm's name off the court documents since I haven't ''retained'' her. Can she do this? Should I insist the firm's name stay on the paperwork? Help!

If the attorney can't seem to get it quite right, why would you think about having her continue on your case. This has already cost you enough money. Cut your losses, get a new attorney and get it done right. Afterward, demand a refund from the attorney for the incorrectly done QDRO work.
