Legal Question in Family Law in Michigan
Change of Custody hearing
I lived in CO for 5 years and have full Physical Custody. The father lives in Michigan and has joint Legal custody. We have been divorced for 7 yrs. The father filed for a custody hearing against me arguing he wants more time with his children (8,11,13yr)and claims he only signed change of domicile under a verbal agreement that I would return in 2 yrs. The father's statements are inaccurate. There is no charges of me being unfit. The judge let it be known he believes in a 50-50 arrangment which prompted my ex to demand I return to MI and split custody or give up the children. Parenting time propsal during mediation shown less time than the now offered 12 wks/yr because of the oldest having less time off in middle school. An offer of 6-9 weeks made. He refuses that and continues to slander me, spread lies, show paritality amongst children, my daughter going to psychologist...I believe case belongs in CO in these circumstances. Can the Judge make his own rulings against MI law, deny change of jurisdiction, and force a change in custody or domicile? Also, my ex has built a house for this judge. Is that conflict of Interest? If the Judge passed my ex's demand for custody change, what are my chances for appeal?

Your case is EXTREMELY complex and trying to sort it out on the web is foolish. What county in Michigan is your case based in? Can you afford an aggressive and experienced attorney?

Re: Change of Custody hearing
You have a very complex case. Multiple states, long case history, potential ethical issues, etc. I am sure that you have a lawyer already. Get an excellent family law lawyer who can deal with all these issues. You shouldn't be getting cursory answers on this web site. If you don't believe your lawyers' answers, get a new lawyer who you trust. A good lawyer may not tell you what you want to hear. William S. Stern
