Legal Question in Family Law in Michigan

change of domicile

My x-husband and I have joint leagal& physical custody of our 2 children. He does not currently exercise his visitation time because he and the children do not get along and he will not attend counseling with them.We were ordered to stay in MI.We have no family no close friends here my children would be much happier to be have the love and support of people that love them and want to support them through this difficult time. We would have a nicer place to live that cost less than the current. They would not be alone after school any more.etc... Is it possible to change the domicile of the children if father is not involved? We live in livingston County!!!

It is possible. However, you would have to set it up properly. Get a job with a tremendous opportunity in the new location to give you an even greater argument as to why you want to leave Michigan. Combine that with the lack of parental involvement and the family support elsewhere, and you have a fighting chance. William S. Stern
