Legal Question in Family Law in Michigan

I have been charged with felonious lack of paying child support. I have applied for social security disability and am on state assistance. Is this legal? I do make support payments but they are less than what is required.

Yes it is legal. Once your arrears reach a substantial level you can expect a felony non-support case. I find the county prosecutors more flexible in resolving the issue than the Attorney General's Office. Either way, it would be best for you to hire an attorney to assist you with a resolution. Yes it is legal. If you are not meeting your monthly child support obligations, then they can charge you with a felony of failure to pay child support once your arrears reach a certain amount. It is no defense to say you cannot pay or that you are disabled because your remedy is to go to the friend of the court and make a motion to modify the child support payments to fit your needs.
