right to do what, obtain custody of your child? you need to retain a family law lawyer who can file the necessary paperwork in an attempt to get custody. you will need proof of her drug problem and/or she will have to present proof to rebut your allegations. however, if the child resides in another state, that court probably has jurisdiction over the child, so you'd have to hire a lawyer there to handle your case.

You can ask the court to modify or amend its previous judgments or orders for proper cause shown (i.e., recurring drug problem). However, assuming that there�s an established custodial environment with your ex, the court will not modify or amend its previous judgments or orders or issue a new order unless you can present �clear and convincing evidence� that it is in your child�s best interest of the child to do so.
