Child Custody

I live in Michigan I have Legal Custody of my neice who is 2 yrs old. She had been in my home for 20 months. My sister is a drug addict and homeless most of the time. My sister was was granted unsupervised visits in Nov. 07. We went to court yesterday in Marion Ohio ( Ohio is where my sister Lives) and they said that she could continue as before with unsupervised visits but in the last 7 months she had addmitted herself to the hospital and spent 3 weeks in the mental ward then checked herself out AMA. She has tested positive for drugs 3 time and was in a motorcycle accident while drunk and under the influance of drugs. She spent 4 weeks in ICU and 2 months in a nursing home. She also does not have a stable place to live. I don't feel that the child is safe with her and I don't know what to do.

I do have a lawyer but am starting to think that she does not know how to handle this or just plain does not care. I will hire a new lawyer if I find out that there is something I can do but right now I feel let down by the whole system. Is there a federal law that can over ride what Ohio is doing? Since Mi. is footing all of the child care bills can they move the case to MI.?

Is the court aware of the drug issues? I would imagine they are, but is your sister required to take random drug tests or anything like that? I'm not sure if you can move the case to MI or not, but at least trying to require your sister to take drug tests randomly might help you.
