Legal Question in Family Law in Michigan

Child custody

In the state of Michigan, at what age may a child petition the court to have his or her custody changed from one parent to another? Also, is this applicable if one of the parents does not have legal custody?

Re: Child custody

Hello, I gave received a copy of your e-mail regarding changing custody of a child. The technically accurate and totally unhelpful answer is at any age and at no age. The child is a minor and under the jurisdiction of the Court, so a change of custody request can be brought at any time. However, the child is a minor, so s/he would need someone (Guardian Ad Litem, possibly the Friend of the Court)to file the Motion on his/her behalf. Obviously, the non-custodial parent could also file the motion. In any event, the tests would be what is the best interest of the child and has there been a substantial change in circumstance? You really should consult with an attorney if you are serious in following through on this issue. You may give me a call if you wish. Domestic matters are an area of concentration for this firm.
