Iam in the process of final stages of my divorce with my wife. Can I get joint physical custody of our 5 month old baby or does the mother usually get physical custody due to baby age???

While the court will consider the child's age, I have certainly seen circumstances where the parents were awarded 50/50 custody of a very young child. Who the court decides to award custody to, or the amount of visitation awarded, depends on a multitude of factors, and what is in the best interests of the child. It is important for your child to have a stable environment at such a young age, and if the mother is still breast feeding, it makes sense that the child maybe spend more time with her.

Think it over carefully. You can always obtain joint physical custody, but have the child reside with the mother 60 or 70% of the time until it is a little older.
