Child support
My children lived with me for about 1 yr (2 girls 15/170 after being removed from their by the state for neglect and endangerment. They have now gone back to live with their mom and she has filed for an increase in support. She never paid support while they lived with me or her share of the medical bills (40%). She claims she only makes $90 a week and she wants $1000 a month plus medical cards provided by me.. She lives with her boyfriend who also lost his kids to the state ( they live with the grandmother)How can I get the court to impute her wages and show that all that money won't be used just for my 2 kids like it should be. Michigan is the state we live in. I also have a credit of $1,143 dollars in overpaid support which I can not get back. My supprot finally stopped after about 3 months after the girls lived with me. She never paid one dime to me and the court said that because my check was no longer garnished for support that was the same as her paying me support. i cannot afford an expensive law firm and I know Michigan has a formula they follow. I need some advice as truly this woman has been working the system for years and yet claims to have no money.

You have a lot of issues and would benefit the most by retaining a family law lawyer to assist you and ensure that you get the child support set at the appropriate amount, and get credit for any overpayments or time periods when the child was not with you. Courts deal with these matters constantly and respond best to those represented by lawyers.
