Legal Question in Family Law in Michigan
Child Support
If you have been divorced for 7 years and you have one child with your ex and you put support on reserve at the time because he wasn't working can you now file to get support or has it been too long? The child is only 11.
Also, if you make more money than your ex but have custody of child will you still be able to get support?

Re: Child Support
You can file a motion for increased child support due to a change in circumstances (that being, that your ex now has a job).
You can't get back support, but from the date you file, you should be able to get a fair assessment of what your ex should contribute.
It doesn't matter that you make more, what they do is calculate a recommended level of child support based on a combination of your salaries, and then divide it up between you.
You can get this done by filling out a form at the Friend of the Court, but you may want an attorney to help walk your through the process and make sure that you give them the information they need to do a good job.
