Child Support

Is there a way to get child support out of my ex-husband when he is self-employed through one contractor. He was working through a temp agency and just recently went back to construction under one guy. He has been in arrears for a couple of years and I sporadically receive child support. Is there a way to get this contractor to take it out he gets paid from the same contractor every week.

It seems to me that if he gets a 1099 from this "employer", then it would be easy to get a wage assignment. You have to file the motion for a wage assignment, subpoena the 1099 from the "employer" and go before the judge or referee. William S. Stern

Depending on whether he receives a paycheck where his employer withholds taxes, or receives a 1099, you will have to garnish. Are your payments currently through the Friend of the Court? They should be taking their own action if he is behind in his support obligation.

If you do not know how to proceed on your own to get the support your are entitled to, you should immediately retain a family law lawyer.
