Child support
My friend and I moved from Mi to here in Florida. Just before the move, he had gotten everything straightened out with CS up in MI. So he thought. He sent in all his paper work, the same paper work, they have been loosing for the past two years, paid up his child support. We get down here and three months later hear he has a bench warrent for not showing up for a friend of the court hearing. He knew nothing about the court date? What should he do? He did nothing wrong and now he is in trouble. No one was ever notified of a Friend of the court, court date. Can he take care of it down here or does he have to go back to MI???

If it is an actual arrest warrant, issued in Michigan, only Michigan can recall or cancel it. All Florida could do, would be to execute it (arrest him), and then it would be up to Michigan whether to extradite him. If it is only a commitment order, then it should only be executable in Michigan.

If there is a warrant issued for his arrest in Michigan he will need a Michigan attorney to deal with it. There are reciprocal agreements in regard to child support issues between the states, so he could be in jeopardy of being arrested in Florida and being returned. A Michigan attorney, knowing all the facts, could talk with the friend of the court to see what is going on. If you need help with this, contact our office.
