Child Support

My husband is paying child support for a child that lives with us. The mother refuses to turn over the checks although the child doesn't live there. Actually she refuses to let him come back and stay. He hasn't lived with her since July 2006 yet they still awarded her support and arrearages where they didn't not honor a court order credit. My husband was the sole wage earner in our home that consisted of two adults and two minor children. Now it is two adults and three children. We can't afford to pay most of our bills, let alone pay an attorney retainer fee. What can we do? Also can we get back the support that was paid to her while he was living with us?

My first suggestion is hire an attorney. If that is really not an option then you should file a motion with Friend of the Court to change child support.

You CAN and SHOULD afford an attorney. If you had done so, you wouldn't be in predicament now. The reality is that you CAN'T afford another day without having an attorney correct this problem. Try discussing the finances and retainer fees with your attorney. I'll bet you can work something out with a competent lawyer.
