Legal Question in Family Law in Michigan

child support

Iam a newly single divorced mother with one child who is 5 months old. My ex is completely against retroactive child support. Does the ''order of filliation law'' apply to me at all in terms of my chances increased by our judge to win in my favor and that is to order my ex to pay me child support retroactive? Plz help. Is there anything I can do to help me win in court???? Thank you for all your help with this question.

Re: child support

If you were separated from your Ex at any time while the child was alive, then he is responsible for retroactive child support from the date you two separated. Do you have a lawyer? You can to make sure your rights are protected and that you get the child support that you are entitled to. What did the terms of your divorce judgment state about child support? All of this should have been outlined in the divorce paperwork.

Re: child support

Filiation would not apply if the child was born while you were married. Child support should have been addressed in your judgment of divorce.

I would be happy to answer your questions in more detail or review your paperwork. Please contact me or another family law attorney for more answers.
