CHILD SUPPORT IN mI

Can you file for child support if the father of the children still lives in the home and married to mother but do not live as husband and wife?

You can only file for child support if you have custody. Chances are, if everyone is living under the same roof, both parents will share custody. The court will enter what is called a status quo order, requiring the other parent to continue paying what was paid in the past. William S. Stern

You can file for child support but it is not likely that the court will force payment while the couple still resides together.
