Child Support
My oldest daughter is 17, and she moved out of the home of her mother about 4 months ago, but is still going to school. I have contacted FOC about this situation and was wondering why I have to continue paying child support to her mother, for this child, when she is not supporting this child any longer. They said I have to pay until the child turns 18 or graduates, regardless. Is this right?

This is in response to your email of July 8, 2001, which this office received on July 9, 2001.
A non-custodial parent is responsible to pay child support until the child reaches the age of 18 or 19 � if the child is a full-time high school student with reasonable expectations of graduating and living with the payee of support. If your ex-spouse is not supporting the child in any way you need to file a motion for a reduction in child support requesting a deviation from the guidelines do to non-support. However, if your ex-spouse is assisting in the support of your child even though your child is not residing with your ex-spouse, you may not be successful with your request. Keep in mind that even is you are successful in such a request, the cost of an attorney may exceed the support reduction you receive especially considering your child is already 17 years old.
