Legal Question in Family Law in Michigan

Child Support

I just recently had my child support lowered due to a decrease in income. My ex did not fill out and mail in her part of the papers so they based it on her income the last time it was modified. My question is if her income is higher than last time would my child support have been lowered even more. Can she get away with doing that, I need to know before I agree to the terms or dispute it.

There are formulas that the Friend of the Court relies upon almost always. The income of the custodial parent is far less important than the income of the non-custodial parent. So don't think that some small increase in your ex's income will make that much of a difference. Bill Stern

Re: Child Support

Hello, I have received a copy of your question regarding child support determination. Yes, an increase in your ex-spouse's income could result in lower child support to be paid by you. John C. Talpos (http://www.Mich-Lawyer.com)
