child support and settlement

i have custody of my 14yr old daughter. Mother is on SSI, pays $25 a month. Mothers mom died due to complications at the hospital and my kids mom is sueing the hospital. If she wins a settlement, is my daughter entitled to any of it? Is this an income she would have to declare? She does absolutely nothing for her.

If your child had a relationship with her grandmother, then she would be entitled to part of the recover due to the loss of the relationship. See a lawyer to pursue this matter. William S. Stern

Most likely no, unless the granddaughter brings her own claim in the lawsuit for loss of companionship if she was close to her grandmother. Otherwise, the money will go to the mother, who has the discretion to use it as she wishes (except for any liens on the lawsuit, medical bills, debts depending on how the grandmother's estate is probated, etc.). If the grandmother has a specific devise in her will for your granddaughter which would include something like this settlement, then she could be entitled to a portion of it when her estate is probated and divided up.
