Legal Question in Family Law in Michigan

child support

My son is incarerated in Georgia. His ex-wife is collecting child support through the family courts in Michigan. He received a letter yesterday requiring him to report to Michigan, in person, on 09-30-04 to show cause as to why he hasn't been paying his support;otherwise a bench warrant will be issued for his arrest.

He is scheduled to go on work release in about 3 weeks; and he was planning on having his child support payments withheld and submitted to Michigan, along with some toward the arrears. However, this hearing is scheduled in just 9 days.

Could you specify the laws governing this type situation - or give me some advise?

Contact the Friend of the Court and inform them of the situation. Follow it up with a writing. Bill Stern

Contact the FOC and tell them that he is in jail in Georgia. He should then request a reduction in the support order based upon changed circumstances Being in jail). Be prepared to tell the FOC when he was sentenced to jail and for what crime he was sentenced.
