Child Support

My wife and I were seperated back in late September 2004, and our divorce is suppose to be final now on June 8th. Due to following my wife to Chicago and then Austin, Texas in support of her job I was unemployed when we returned to live in Michigan. She stated she wanted a divorce then in September. We did go to ''Friend of the Court'' in December of 2004 and I was still unemployed but was told I needed to pay her about $220.00 a month but then never got anything from Friend of the court.

I was then employed in February of this year and did notify Friend of the court of my employment along with pay stubs. As of now I still have not heard anything or given any figures from Friend of the court regarding child support amount.

My question is when I do hear something would I have to pay back pay to my ex in child support?. I don't see why I should since I was never notified by friend of the court after I was employed, and I still have yet to hear from them. So how was I to know what I was even suppose to pay. I have given my ex money for medical bills and other things for my son which I have records of. I would just hate to be hit all of a sudden with a HUGE bill for back pay when my monthly support starts, whenever that will be.

Go check out the file and see if there is an order requiring you to pay support. If not, you are okay. If there is an order, then you will have a big arrears. Bill Stern 248-353-9400

You are probably under court order to pay the child support (that is, if the FOC recommendation was ever turned into an order and signed by the judge). If so, you will be responsible for the arrearage regardless of whether you heard from the FOC. You could always bring a motion asking for relief from the arrearage, but it is unlikely you will get that relief. For more info, please contact my office at (248)851-3171.
