This will be up to the parents to decide. In Michigan the father will be asked to sign an acknowledgement of paternity at the time of birth and the chosen name should be consistent on all legal documents to avoid problems in the future. I generally advise clients to use the father's name but to hyphenate mother and father's name if there are problems in a relationship.
