Children's Sport Activities

I have primary physical & legal custody of our 13 & 10 year old. Their father has visitation every other week-end. We live two hours from him. The children are involved in sports & school activities but if they fall on his week-ends, he refuses to take them. What can I do?

This is up to the call of the judge. You have to file a motion with the judge explaining why the father's refusal to take the kids to the events means that they cannot participate in the sport, etc. The father will come in and explain how he rarely gets to see the kids and you are attempting to interfere with the limited time that he spends with them and how it ruins events and things that he has planned. Honestly, most judges say that during his time, he can do with them as he pleases but it is up to the discretion of the judge. William S. Stern

I don't know of any judges that will force a non-custodial parent to exercise their parenting time.

I don't know of any judges that will allow the custodial parent to schedule activities that interfere with the non-custodial parent's parenting time. That would change if the non-custodial parent approved of, or participated in the activities.

Please encourage the children to see their father and schedule their activities around his visitation. Alternatively the kids should see to it that their father is actively involved in their activities.
