A Child's Rights

If a child is in foster care, at what age is that child allowed to leave, or can the child pick a different family to live with?

Re: A Child's Rights

Dear Sir/Madam:

This is in response to your email of May 5, 2001, which was received by this office on June 20, 2001.

There is no set age that a child can request a change in foster care parents. However if the child is mature enough to express a request for a change or can explain his or her request and there is some basis to the request the agency responsible for the placement of the child should react.

A child can leave the foster care system upon reaching the age of 18, unless a Court Order requires further placement until a later date.

Sincerely,

Michael D. Eberth
