Legal Question in Family Law in Michigan

chlid custody

I have two boys one 7 and t the other 4. Both live with their mother in the state of Michigan (Ingham County) I have Joint Physical Custody but I live in Dallas Texas. I would like to change the primary housing location not go for 100% custody, meaning I want the boys to live with me most of the time. What big challanges am I to expect? They are to come to TX for the holidays, what is the worst that might happen if I don't return them? The mother has them in a poor enviroment and also some severe medical issues.

If you don't return the kids, you will be facing felony parental kidnapping charges. As far as moving the kids, it will be an uphill battle. You are the one who moved away, right? In fact, it is likely that you will lose your joint physical custody status. If the mother is unfit, be prepared for a big battle to prove it. This is a battle that will cost you a lot of money. You have raised a question that is not easily answered in a brief response. The key is whether there has been a substanital change in the custodial environment that makes it in the best interest of the children that their domicile be changed. You might wish to consider extended parenting time during school vacations as an alternative. You definitely need to consult with an attorney.
