What constitutes a custody change?

I have physical and legal custody of my son who will be turning 16 this month, I have had that since his birth. His biological father has visitation (there was no divorce never was married) I received papers today out of the blue suing me for full physical custody, the only grounds listed were that my son said he wants to live with him (news to me), he also stated it would be a better home life and he would do better in school. My son has a learning disability a minor one. My husband and I have been married 14 years and he is basically the only dad my son has had. His biological father is on his 3rd marriage to a women who is also on her 3rd marriage. He has never had anything to do with his school life until this past spring. I just wanted to know what or if any chance he has of getting custody of my son and what I need to do to fight this?

The father really has no grounds for change of custody. With the right attorney, I think you will do quite well...
