Legal Question in Family Law in Michigan

Credit card debts

My husbands has several credit cards under his name and purchased items for his personal use. None of the items purchased in no way were for gifts for me neither were they to be used in the home in any capacity whatsoever. I have an a+ credit, i have my personl credit cards, i am never late with payments. He filed for bankruptcy prior to our marriage. God forbid, if for some reason something happens and he is unable to pay his present debt of $12000.00 plus, am i legally responsible? Can the debtors come after me?

Thanks for your assistance in this trouble thought of mine.

Re: Credit card debts

To Whom It May Concern:

This is in response to your email of May 7, 2001, which this office received on June 19, 2001.

The basic law in Michigan states that each party is entitled to 50% of the marital assets and responsible for 50% of the marital debt. However, you may be able to prove that these debts are non-marital and that your husband is solely responsible.

If the credit cards are jointly held, then you are responsible for payment.

Please contact my office if you wish to discuss this matter further.

Sincerely,

Nichols & Eberth, P.C.
