Legal Question in Family Law in Michigan

custody of minor

daughter is living with man in Michigan who has fathered her child. They are not married, he is emotionally abusive of her, threatening to kick her out and seek custody of 7 month old child. She wants to come home to Indiana with, of course, the baby. Her options/rights?

She can certainly leave him, and I would strongly suggest that she does. However, she should immediately file paperwork with the court in the county where she ends up residing to establish custody, visitation, and child support. If she simply leaves, then he will file in Michigan and it will look like she just took off (although she will have a chance to present her evidence as to why she left, i.e., a dangerous and unhealthy environment.)
