Legal Question in Family Law in Michigan
Custody Papers and Visitation rights?
We have a temporary Custody and Visitation Order, which states that my husband can not take our son until he has ''Obtained housing and has an approved child safety seat. And parenting time may not take place at his mothers home.'' He as of this date still has not obtained housing.
I called FOC, the person on the phone said that since the papers do not say ''visitation as per the FOC parenting time handbook'' and that he has not obtained housing that I do not have to let him take our son. Or I can tell him what I expect in order from him to take him. Is this true?
Thank You in advance.

Re: Custody Papers and Visitation rights?
Hello, I have received a copy of your e-mail regarding visitation. I am hesitant to affirm what the Friend of the Court has said without seeing the actual Court papers. However, it sounds likely to be correct. Furthermore, it is the Friend of the Court who will construe the Order in the first instance. John C. Talpos (http://www.Mich-Lawyer.com)
