Can a proled Father get joint custody?

The question I believe is whether or not a paroled father (from prison) can get joing legal custody. The answer is that the best interest factors of the child are taken into consideration by any judge determining the case. Therefore, the party filing a petition for custody has the burden of proving all of these factors. In addition, there has to be a change of circumstances if custody has already been determined by a court and if an established custodial environment has been established, the moving party has to prove that a change is necessary by clear and convincing evidence.
