Legal Question in Family Law in Michigan
Custody Question
I'm 47 years old, my wife is 38 and we have two kids - six and two. We moved to Michigan three and a half years ago so my wife (she transferred with her company) could be closer to her family in Ohio. I got a job (staff writer) soon after we got here but was laid off in November and haven't had full time work since. Now, in large part to the stress this financial duress has put on our relationship, my wife wants a divorce. I should also mention I've been in counseling for depression which certainly didn't help the situation. I should also mention my wife has been on a rigid physical and dietary regimen for the past few months, in which she has lost much of the weight she gained after the birth of our first son. My question is: Do I have any recourse regarding custody of our children just because she's got a full time job and I don't? It was quite a blow to lose my job (and I look for work virtually every day) and awful to lose the mate I loved but I don't know how I I'm going to take losing my kids as well.
Thank you.

Hello, I have received a copy of your post regarding custody. The test is what is in the best interest of your children. Unfortunately there is a gender bias when it comes to young children, as yours are. You should consult with an attorney who can go over the child custody factors with you and help you make a determination regarding your questions.Feel free to contact me if you desire.
