Legal Question in Family Law in Michigan

custody

I am seperated from my wife. Not legaly just not living in the home. My fear is she will take my 4 year old and move to the state of Florida. What are my rights if she does?

Ifitisturely a concern, perhaps you should see a lawyer who can file for either a legal separation or divorce. The initial orders would prevent her from leaving the state. Right now,as it stands,she has equal standing with you totake the child anywhere she wants. Bill Stern

Generally, one parent cannot remove a minor child from the state without court authority. If she does, that parent could be charged with parental kidnapping. Depending on your situation you may need to take legal action immediately to prevent your wife from taking your 4 year old to Florida. You should get an attorney to help you prevent that.
