Legal Question in Family Law in Michigan

Custody of Son

My brother is looking to get custody of his son. We went down to the courts and got a date set. I am wondering how important it is for my brother to get a lawyer, and how bad it would be if his ex-girlfriend shows up with one and he doesnt. Now is has already had one child taken away from her, she doesnt work and when she does it only last 2 weeks at a time. She does drugs and drinks. The whole family smokes in the house and the child has asthma. There's 8 ppl living in a small 2 bedroom house, where the child sleeps with his mother, which he is 8 y/o. My brother pays her support every week and has papers showing he does. The money given to her is spent all on herself, she does not give my nephew the care he needs, hes always dirty, nails aren't cut, clothes always raggy and dirty..despite the fact my brother is always buying him new clothes. The child's uncle beats up on him which I have pictures of bruises. I'm wondering what leg my brother has to stand on.

I think it is always good to have an attorney on your side to help navigate you through the process. It's hard to say what a judge would do because we're only getting one side and who knows what his ex will say. The more objective evidence you have (meaning not a he-said, she said), the better your chances of convincing a judge.

Re: Custody of Son

If you look at what he has blown money on in the past and look at what is the most important to him in his life, the answer becomes obvious. William S. Stern

Custody of Son

If your brother is well qualified to practice law, and if he's got lots of experience with family courts, perhaps he's got a change. However, even though I practice family law for a living, I'd never consider representing myself. That's just plain stupid.
