Legal Question in Family Law in Michigan
custody and visitation laws in michigan
I am planning to move to Windsor Ontario soon. The move is only about 20 minutes from my current home. After my divorce, I was awarded primary cstody of our daughter. But, through my ex wife having been able to get a change made, she now has her just over 1/2 the time. she is now trhreatening to contest my moving. Part of the reason for the move is sue to my having accepted the responsibility for keeping our house based on an expectation of a pre-determined amount of child support to aid in managing this. Through her new husbands unlimited funds, and her continued deceptions and lies to the family court, she was able to modify the visitation and I now have to pay her child support. Hence, I am loosing my home to forclosure as a result.
I have been blessed with having met a woman I have dated for a year now and we will be getting married soon. She lives in Windsor; I will be moving there. I see no reson this should be an issue, but her attorney is sending me threatening letters about this. I will be living a lesser distance from my currnet home than the location her mother moved to when she remarried. It jsut happens to be accross the bridge.
Am I entitled to do this witout fearing loss of my visitation time?

No, you are not. It is a big deal. You will need the court's permission to move out-of-state and still be allowed visitation.
How old is your daughter? Does she already have a passport?
I think that you likely can convince the judge, but you will have to work for it.
