Legal Question in Family Law in Michigan
Do I have the right to take my daughter back home?
I got custody of my two daughter (14& 16) two years ago. A year ago, my oldest daughter went back to live with her mom. We never changed custody on paper. Now my ex-wife has moved to Oklahoma with a guy she met on the Internet, and has only known for one month. She met him for the first time on a Sunday and on Tuesday was on her way to Oklahoma. She left my daughter with a neighbor to finish the school year. I want to take my daughter back because I do not want her going to live with a man no one knows, and my ex could not possibly know. I gave permission for my ex to take my daughter because she told me she was moving for a job and would be living on her own. Does my custody still stand even though my daughter has been living with her mom for a year?

Re: Do I have the right to take my daughter back home?
Dear Sir:
This is in response to your email of April 17, 2001, which was received by this office on June 13, 2001.
The overriding factor that the court will take into account is what is in the best interest of your daughter. Your wife leaving your daughter with a neighbor while she runs off to Oklahoma to meet a potential companion that she met on the internet does not sound like a situation that is in your daughters best interest.
Sincerely,
