Legal Question in Family Law in Michigan

My daughter was separated from her husband and had a one night affair with a friend. That friend has a legal aid lawyer now and is suing for a paternity test. This man is a on ssi and does drugs. He is only 23 and is trying to take the 2 year old away from our daughter. Her husband has accepted her as his own because she was born during their marriage. They are now divorced and our daughter is remarried. Can this friend legally do this to her?
