Legal Question in Family Law in Michigan
MY DAUGHTER IS 8 YEARS OLD, AND HER MOTHER AND I SEPARATED BEFORE SHE WAS A YEAR OLD. SINCE WE HAVE SPLIT, ITS BEEN A NEVER ENDING BATTLE WITH HER WHEN IT COMES TO OUR CHILD. I HAVE MY DAUGHTER EVERY OTHER WEEKEND, ALONG WITH ONE DAY A WEEK. I HAVE INSURANCE ON HER, AND I ALWAYS HAVE. I ALSO PAY THE MOM ALMOST 500 A MONTH IN CHILD SUPPORT. I HAVE MAINTAINED THE SAme JOB FOR ALMOST 5 YEARS NOW ALONG WITH THE SAME GIRLFRIEnd. I've WANTED NOTHING BUT STABILITY FOR MY DAUGHTER. HER MOM HAS LIVED WITH A COUSIN, MOVED TO HER MOMS FOR OVER A YEAR, AND RECENTLY JUST PURCHASED A HOME. SHE JUST BOUGHT A BRAND NEW JEEP A FEW MONTHS AGO. SHE HAS HAD NUMEROUS MEN IN AND OUT OF MY DAUGHTERS LIFE, AND EVEN PAID TO GET A BREAST ENHANCEMENT. SHE GOT FIRED FROM A JOB FOR CALLING OFF TOO MUCH, THEN BECAME A RN WHERE She WORKED MIDNIGHTS. I WORK DAYS AND TOOK HER TO COURT HOPING TO GET MY DAUGHTER EVERYNIGHT AT 8pm UNTIL THE MORNING WHEN HER MOTHER GOT DONE WORKING SO THAT SHE WOULD ALWAYS BE WITH ONE PARENT OR THE OTHER BECAUSE OUR SCHEDULES WORKED PERFECT LIKE THAT. FOR A PRIMARY BABYSITTER, MY DAUGHTER IS AT HER MATERNAL GRANDMOTHERS HOUSE, WHICH I CAN SEE FROM MY PORCH, ITS NOT EVEN A BLOCK AWAY. WHEN WE WENT TO COURT, HER AND THE JUDGE AGREED THAT IT DIDN'T MATTER WHERE MY DAUGHTER WAS AT NIGHT BECAUSE SHE WAS SLEEPING. I APPEALED THE DECISION, AND WAS DENIED YET AGAIN, BUT IN RETURN I GOT 2 EXTRA HOURS OF TIME WITH MY DAUGHTER A WEEK. WHAT A JOKE. NOW SHE IS TELLING ME SHE IS TAKING ME BACK TO COURT BECAUSE SHE NEEDS MORE MONEY, BECAUSE SHE HAS OUR DAUGHTER 90% OF THE TIME. THAT WAS HER CHOICE, SHE NEVER OFFERS OR ASKS ME TO WATCH HER IF SHE NEEDS A BABYSITTER NOR WILL SHE GIVE ME MORE THAN THE MAXIMUM AMOUNT OF TIME AWARDED BY THE JUDGE IN COURT. WHAT SHOULD I DO?

To start, take your caps lock key off. I feel bad for your daughter. I'm sure she is well aware of the arguments and will carry these scars. Anyway, the best thing you can do is argue on the basis that there is really no change in circumstances and the payments you now make are part of the prior deal. Just marshall your arguments and go forward.
