Legal Question in Family Law in Michigan
Debt Responsibility from Divorce
I was divorced two years ago and mistakenly did not omit that we would split a debt of $16,000 on our divorce papers even though my ex ripped up the hand written note he originally had stamped by the notary public. Now that he financially strapped, he is demanding that I make the payments directly to him. The thing is, I found out after our divorce that I have no possession or any part to the deed on the house, but I didn't contest it and he could sell it and keep the equity. He wants me to make checks directly to his name, which I refuse but will make payments to the loan company. My question is: Are there any tax benefits to my making payments on a home refinancing loan if I don't own the home and my name is not on the loan repayment? In the state of Michigan, does my handwriting on the divorce papers about the ''splitting of debt'' hold me liable to the debt if the debt is fully in his name and he never included me on the ownership of the property?
