Legal Question in Family Law in Michigan

Desperately need help!

I was charged with child abuse third degree. The victim was my 16yr. old daughter. I want to know can they consider my daughter a child, and can they talk to our daughter without our permission after she told them she didn`t want to talk to them?

Contact a criminal defense attorney right away to assist you with the criminal charge. Since your daughter has not reached majority she is still considered a child by the State. Since she is the alleged victim of a crime allegedly committed by a parent against her, the law allows for the authorities to talk with her without the parent present. In addition to the criminal charge you can expect to have an abuse/neglect petition filed against you in Juvenile Division of Family Court - especially if there are other minor children in the home. You should contact an attorney who handles abuse/neglect cases to assist you. It would be preferable to have the same attorney represent you in both actions if the attorney is qualified to do so. If you do have separate attorneys it is important that they work together to obtain a satisfactory outcome for you and to insure that your rights are protected. Even though the law allows for your daughter to talk with the authories, she doen't have to speak with them if she doesn't want to.
