Difference bewteen Legal Separation and Filing for Divorce
I would like to know the difference between legal separation and the process of filing for divorce. I am the health benefits carrier and would my husband be denied health benefits if I file for a legal separation? When does the value of a divorce take place, when a couple is legally separated or when legal divorced? I have been married to my husband for (5mos shy of ) 30 years. Would I be entitled to spousal support even if I have a job? I have been used to a certain way of lifestyle and could that be a consideration in my divorce outcome? I understand the value of retaining a good family law attorney but would like to go into my visit with some basic information so that I do not waste his time and my money. I want to make sure that I get my fair shair of the joint property that my husband and I hold together. We have a vending company and a properties company that we have rental homes and land parcels. He is currently having an affair with a girl have our age ( we both are 50). Their is no room for reconciliation and we have one minor child and one child that is 19 living at home. I want to go for the gusto and receive my fair share. My husband could not have created the companies that exist without my help and support.

You are in a very strong position to either get a large chunk of the business, take over the business or get payments for years to come. The value of the business could be purchased by your husband from you in one lump sum. The value of the business can be evaluated by an appropriate expert. If you file for legal separation, the process is basically the same as for a divorce. The spouse is entitled to remain on the health insurance with a legal separation as you are still married.
