Legal Question in Family Law in Michigan

distance

My ex- girlfriend left me with our 3 yr. old child, and has moved an estimated 270 mi. away. Is there a law saying that she has to be within so many mile of me?

Re: distance

Please clarify, who has the child? If you have the child, and you want to have sole custody of the child, you should bring a suit for custody. Issues of distance will be resolved in that custody proceeding. Usually, there is a 100 mile rule, but that is merely something that is considered by the court, and an exception may be granted. for more info, please contact my office at (248)851-3171.

Re: distance

It is much more difficult now that she has made the move and you did not have a prior court order in effect. If you had taken steps before the move, it would most likely have contained a clause preventing such a move more than 100 miles. Now, you must deal with what is. Get a lawyer. William S.
